TERMS AND CONDITIONS – BELLA VIDA RESORT

Article 1 – General

1.1. These terms and conditions apply to every stay, use of facilities, and participation in activities at Bella Vida Resort (hereinafter referred to as ‘the Resort’), located in Pecatu, Bali, Indonesia.

1.2. By entering the Resort and/or using its facilities, the guest declares to have read, understood, and agreed to these terms and conditions.

1.3. These terms apply to all guests, visitors, and third parties present on the Resort premises, whether or not they have made a reservation.

1.4. The signing guest is also responsible and liable for the conduct and compliance with these terms by all persons belonging to his/her party or any visitors he/she allows on the Resort premises.

Article 2 – Own Risk and Liability

2.1. Entering the Resort and using any of its facilities – including but not limited to the swimming pool, gym, spa, restaurant, bar, stairs, roofs, terraces, garden, vehicles, electrical systems, and other amenities – is entirely at the guest’s own risk.

2.2. The Resort, its owners, management, and staff cannot be held liable for any injury, loss, theft, damage, or death occurring during or as a result of a stay at the Resort.

2.3. The liability of Bella Vida Resort is at all times limited to the amount covered by its insurance, with a maximum insured amount of €150,000 (one hundred and fifty thousand euros) per incident.

2.4. The guest indemnifies Bella Vida Resort from any third-party claims related to damages or losses caused by the guest, their negligence, or by persons under their responsibility or whom they have allowed access to the Resort.

Article 3 – Safety and Conduct

3.1. Guests must follow all safety instructions, house rules, and directions from staff at all times.

3.2. It is not permitted to create dangerous situations, use alcohol or drugs in a way that causes danger or nuisance, or enter restricted areas.

3.3. Parents or guardians are at all times responsible for the safety and behavior of minors under their supervision.

3.4. Use of the swimming pool is only permitted for guests who can swim. No permanent lifeguard is present.

3.5. The Resort is not liable for insect bites, sunburn, slipping, falling, or any other accidents occurring on the premises.

Article 4 – Personal Belongings

4.1. Bella Vida Resort accepts no responsibility for the loss, theft, or damage of guests’ personal belongings.

4.2. Guests may use an in-room or reception safe; use of the safe is at their own risk.

4.3. Valuable items should not be left unattended.

Article 5 – Damages and Costs

5.1. Guests are liable for any damage to buildings, furniture, garden, swimming pool, or other property of the Resort caused by themselves, their party, or visitors.

5.2. Any damage must be paid for immediately or upon check-out and may be deducted from the deposit.

5.3. Lost keys or remotes may result in replacement fees.

5.4. The signing guest is responsible for ensuring that all persons under their booking or visiting the Resort comply with these terms.

Article 6 – Force Majeure and Exceptional Circumstances

6.1. Bella Vida Resort is not liable for damage or inconvenience caused by force majeure, such as power outages, water shortages, weather conditions, natural disasters, pandemics, technical failures, government measures, or other circumstances beyond the Resort’s control.

6.2. In such cases, no refund or compensation is due.

Article 7 – Stay and Departure

7.1. Guests must leave their room and the Resort grounds in good condition.

7.2. Check-in and check-out times are communicated in advance; late check-out may incur additional fees.

7.3. Bella Vida Resort reserves the right to deny access without refund to guests who violate the rules or cause disturbance.

Article 8 – Applicable Law

8.1. These terms and conditions are governed by Indonesian law.

8.2. Any disputes shall preferably be resolved amicably. Failing that, disputes will be submitted to the competent court in Denpasar, Bali.

Article 9 – Acknowledgement and Signature

By signing below, the guest acknowledges having read, understood, and agreed to these terms and conditions. The guest accepts full responsibility for their own actions and those of their party or visitors, and will not hold Bella Vida Resort or its staff liable for any injury, loss, or damage, except as covered by the Resort’s insurance policy with a maximum of €150,000.
