These Terms and Conditions constitute a legally binding agreement between the guest and Bella Vida Resort.

Article 1 – General
1.1. These Terms and Conditions apply to every stay, use of facilities, and participation in activities at Bella Vida Resort (“the Resort”), located in Pecatu, Bali, Indonesia.
1.2. By entering the Resort premises, making a reservation, or using any of its facilities, the guest confirms having read, understood, and agreed to these Terms.
1.3. These Terms apply to all guests, visitors, and third parties present on the Resort premises.
1.4. The booking guest is responsible for compliance with these Terms by all persons included in their reservation or allowed onto the premises by them.

Article 2 – Use of Facilities and Limitation of Liability
2.1. Use of the Resort and its facilities — including but not limited to the swimming pool, gym, spa, restaurant, bar, terraces, gardens, stairways, pathways, vehicles, and other amenities — is at the guest’s own risk.
2.2. The Resort shall not be liable for injury, loss, theft, damage, or death occurring during or in connection with a stay, except in cases of proven gross negligence or willful misconduct by the Resort.
2.3. Where liability is legally established, it shall be limited to the extent permitted under applicable law and to the coverage provided by the Resort’s insurance policy.
2.4. Guests indemnify and hold harmless the Resort from third-party claims arising from damage, injury, or loss caused by the guest, their party, or visitors under their responsibility.

Article 3 – Safety and Conduct
3.1. Guests must comply with all safety instructions, house rules, and directions given by Resort staff.
3.2. Dangerous behavior, excessive noise, illegal activities, misuse of alcohol or drugs, or entering restricted areas is strictly prohibited.
3.3. Parents or guardians are fully responsible for minors under their supervision.
3.4. The swimming pool is unattended. Guests must ensure appropriate supervision at all times.
3.5. The Resort is located in a tropical environment. The Resort is not liable for incidents related to weather conditions, insects, wildlife, natural surfaces, or environmental characteristics inherent to the location.

Article 4 – Personal Belongings and Safe
4.1. Guests remain responsible for their personal belongings at all times.
4.2. The Resort provides a safe for guest convenience.
4.3. The Resort shall not be liable for loss, theft, or damage to personal belongings, including valuables stored in the safe, except in cases of proven gross negligence or willful misconduct by the Resort.
4.4. Guests are strongly advised to store money, passports, documents, electronics, jewelry, and other valuables in the safe.
4.5. Failure to use the safe may limit any potential liability of the Resort to the maximum extent permitted by law.

Article 5 – Damages and Compensation
5.1. Guests are liable for any damage to buildings, rooms, furniture, equipment, landscaping, or other property caused by themselves, their party, or visitors.
5.2. The Resort reserves the right to charge for repairs, professional cleaning, replacement, and loss of income resulting from damage.
5.3. Costs may be charged to the guest’s payment method or settled upon departure.

Article 6 – Fire Safety, Smoking and Open Flames
6.1. All indoor areas are strictly non-smoking.
6.2. Smoking is permitted only in designated outdoor areas, if indicated by the Resort.
6.3. In case of violation, the Resort reserves the right to charge all costs related to cleaning, restoration, and any resulting damages or loss of income. Minimum charge: 2.500.000 IDR or equivalent in IDR, without prejudice to higher actual damages.
6.4. Due to the presence of natural and highly flammable materials, including traditional alang-alang roofing, any form of open fire is strictly prohibited.
6.5. This includes candles, incense, mosquito coils, burners, fireworks, gas equipment, barbecues, or personal cooking devices.
6.6. Violations may result in immediate termination of the stay without refund and full liability for damages.
6.7. Strong Odor Food Policy
Due to hygiene standards and the comfort of other guests, the possession, storage, preparation, or consumption of durian fruit inside rooms or indoor areas of the Resort is strictly prohibited.
If durian is brought into indoor areas, the Resort reserves the right to charge all costs related to professional cleaning, deodorizing, and any resulting loss of income. Minimum charge: 2.500.000 IDR or equivalent in IDR, without prejudice to higher actual damages.

Article 7 – Third-Party Services and Scooter Use
7.1. The Resort may assist guests in arranging transportation, scooter rental, tours, or other third-party services. Such services are provided by independent providers unless expressly stated otherwise.
7.2. Any use of scooters, motorcycles, bicycles, or other vehicles arranged through or rented at the Resort is entirely at the guest’s own risk.
7.3. Guests are solely responsible for inspecting any rented vehicle before use, including but not limited to brakes, lights, tires, fuel level, mirrors, and general condition. By using the vehicle, the guest confirms that it has been inspected and accepted in satisfactory condition.
7.4. Guests are responsible for ensuring they hold a valid driving license and comply with Indonesian traffic laws, including helmet use.
7.5. The Resort shall not be liable for accidents, injuries, damage, mechanical failure, theft, or any consequences arising from the use of scooters or other vehicles, except in cases of proven gross negligence or willful misconduct by the Resort.
7.6. Guests shall indemnify and hold harmless the Resort from any third-party claims, damages, fines, or liabilities arising from their use of a rented vehicle.
7.7. The Resort does not provide insurance coverage for rented vehicles unless explicitly agreed in writing.

Article 8 – Force Majeure
8.1. The Resort shall not be liable for failure to perform obligations due to force majeure, including but not limited to natural disasters, power outages, water shortages, extreme weather, pandemics, government measures, or technical failures beyond its reasonable control.
8.2. In such circumstances, refunds or compensation shall not be due except where required under applicable law.

Article 9 – Stay and Termination
9.1. Check-in and check-out times are communicated in advance.
9.2. Late departure may result in additional charges.
9.3. The Resort reserves the right to deny access or terminate a stay without refund if a guest violates these Terms or endangers safety, property, or other guests.

Article 10 – Data Protection and Registration
10.1. The Resort collects and processes personal data, including passport information, for legal registration, immigration compliance, and administrative purposes.
10.2. Such data will be handled confidentially and in accordance with applicable Indonesian laws.
10.3. By providing identification documents, the guest consents to this processing.

Article 11 – CCTV
11.1. For safety and security purposes, CCTV may be in operation in certain common areas of the Resort.
11.2. Recordings are used solely for security and incident investigation purposes.

Article 12 – Applicable Law and Jurisdiction
12.1. These Terms are governed by the laws of the Republic of Indonesia.
12.2. Disputes shall first be resolved amicably.
12.3. Failing amicable resolution, disputes shall be submitted to the competent court in Denpasar, Bali.

Article 13 – Acknowledgment
By signing below, the guest confirms:
• Having read and understood these Terms and Conditions
• Accepting responsibility for their own conduct and that of their party
• Acknowledging the fire safety and no-smoking policy
• Acknowledging the personal belongings policy
